Article 1: General Provisions

The services offered by OldFashiond through this site are reserved for users aged 40 and over. By creating an account allowing access to these services, users agree to be bound by these Terms and Conditions of Use. These Terms apply as soon as the online subscription is completed, which constitutes confirmation by the user that they have read and approved the said Terms and Conditions of Use and accept that they are the only applicable terms.

Article 2: Registration

Creating a profile is free of charge. The user agrees not to create more than one account. The user also agrees to provide accurate information and to keep it up to date. None of this information will be published or shared. Only OldFashiond has access to this information.

Article 3: Pricing

The prices stated relate exclusively to the subscription fee. They always include VAT and other mandatory taxes borne by the customer. The price indication refers solely to the subscription fee. Prices may be adjusted at any time but cannot be applied retroactively, and the new prices apply as soon as the user has access to the information available on the site.

Article 4: Questionnaire

After creating their profile, the user is invited to complete the questionnaire provided on the site. This questionnaire enables OldFashiond to provide quality services. It is therefore important to complete it accurately and thoroughly. OldFashiond undertakes not to publish any information collected through the questionnaire and to use it exclusively for the provision of its services.

Article 5: Offer

The subscription offer is valid for any user who has previously completed their profile and questionnaire and has successfully completed the payment. The subscription is taken out for a for a period determined by the current offer and is renewable in 1-month increment. OldFashiond will send an email to the subscribed user when a match is found (one “match” at a time), with the displayed contact details of the designated person. The user remains solely responsible for initiating contact with the designated person.

Once the user has completed their questionnaire, their profile is integrated into our database of possible matches in order to identify compatible people.

However, the user will only receive real match proposals after purchasing a subscription, as only subscribed people can benefit from a real match, verified and validated by our team.

When a match is offered to the user, both people must accept in order for an exchange to take place. No conversation is possible without this double validation.

Article 6: Subscription, Renewal, and Cancellation

15 days and 24 hours before the expiration of the first month subscription and depending on the current offer, OldFashiond will send an email to the user informing him of the possibility to renew his subscription or to stop the subscription via the button "Unsubscribe" on the subscription page. This will cancel the renewal of the subscription. This action will also delete the user’s profile. Terminating  the subscription does not cancel the current commitment. If you cancel within the subscription month, the month remains payable. During this commitment period, your account remains active. You continue to receive matches and have access to the contact details of compatible people. You can always log in, edit your profile, pause your profile or if you wish unsubscribe later.

Once your commitment period is over, you will still be able to receive notifications announcing a match. Though in order to have access to the contact details of the person concerned, you will need to take a new 1-month subscription. 

If the user does not unsubscribe in time (either 24 hours before), at the end of the first month (or at the second month offered), the subscription will be automatically renewed, and this for a new commitment period of 1 month.

Article 7: Withdrawal Period

The user has the right to inform OldFashiond that they are cancelling the purchase, without penalty and without providing a reason, within 14 days starting from the day after receiving the product. However, the user must pay OldFashiond an amount proportional to the services provided up until the moment they informed OldFashiond of their decision to withdraw from the contract. The remaining balance will be refunded to the same account used for the initial purchase.

Users wishing to exercise their right of withdrawal must contact OldFashiond's customer service within 14 days of receipt. They are requested to complete the withdrawal form and send it by email.

Article 8: Warranty and Liability

OldFashiond declines all liability for events of any nature that may occur during interactions between users of the site after a “match” has been indicated.

In general, OldFashiond will take care to process any information received from a user regarding potential inappropriate behaviour from other users, in order to ensure that the affected user will no longer be exposed to it.

Article 9: Security and Confidentiality

Personal data is processed with the utmost confidentiality. All personal data collected remain the property of OldFashiond and will not be transmitted, rented, or sold to third parties or to any user of the site. OldFashiond undertakes to use your personal data exclusively within the scope of the “matching” services offered.

You may, at any time, request, correct, modify or delete the data we store in OldFashiond’s customer records.

OldFashiond strictly complies with the Belgian Law of 30 July 2018 regarding personal data and is in full conformity with the General Data Protection Regulation (GDPR).

OldFashiond uses cookies. Cookies consist of a standard internet technology used to store certain information and make it accessible on the user’s system. Cookies cannot be used to identify individuals; a cookie can only identify a machine. By using our services, you consent to the use of cookies.

OldFashiond keeps anonymous visitor statistics to analyse which pages are visited and how often.

Article 10: Invalidity – No Waiver

If any provision of these Terms and Conditions of Use is declared invalid, illegal, or void, this shall in no way affect the validity, legality, and applicability of the other provisions.

The failure of OldFashiond to exercise any of its rights at any time shall never be interpreted as a waiver of such rights.

Article 12: Amendments to the Terms

OldFashiond may modify its Terms and Conditions of Use at any time without prior notice. Any purchase or subscription renewal after the modification implies acceptance of the new Terms by the users.

Article 13: Evidence

The customer agrees that electronic communications and backups may serve as proof.

Article 14: Dispute Resolution

Subject to any mandatory legal provisions and unless OldFashiond waives this requirement, any dispute shall be brought before the courts of the district in which OldFashiond’s registered office is located. Belgian law shall apply.
